Civil Trial Experience

Versa Marketing, Inc. v. Precision PMD, Summit County Court of Common Pleas, Case No. CV 2015-08-3964 (First chair, Jury Trial). I represented a buyer of industrial equipment in a dispute concerning defect ad breach of contract allegations.

Gary Shulman v. David Kelley, Medina County Court of Common Pleas, Case No. 15CI1172 (First chair, Injunction/ Receivership proceeding). I represented a 50% co-owner in a firm that provides assistance to corporations and attorneys regarding retirement benefits in a dispute with a “corporate divorce” setting, and successfully defended against an injunction and a receivership.

Ojala Properties, LLC v. Clear Channel Outdoor, Inc., United States District Court, Northern District of Ohio, Case No. 1:13CV1226 (First chair, Injunction/ Board of Revisions proceedings). I represented a landlord in a dispute with a tenant concerning a commercial lease, obtained injunctive relief on behalf of the landlord leading to the revocation of permits and termination of the lease.

In re Freedom Filler, LLC, United States Bankruptcy Court, Northern District of Ohio, Case No. 13-10619 (First chair, Bench Trial). I represented an involuntary debtor in a Bankruptcy action over a dispute concerning alleged breach of contract and other disputes arising out of a commercial contract involving Roll- Your-Own machines.

Stow Bridgewater Property, LLC v. Creative Playrooms, Inc., et al. Cuyahoga County Common Pleas Case No. CV-11-756012 (First chair, Bench Trial). I represented a commercial tenant in a dispute concerning alleged construction defects and unpaid rent.

Cheap Escape, dba JB Dollar Stretcher v. RR Donnelley & Sons Co., Northern District of Ohio, Case No.: 3:12-CV-00083 (First chair, Bench Trial). I represented Cheap Escape, in a dispute concerning billing discrepancies.

John Passe v. Bruce Uncapher, Cuyahoga County Court of Common Pleas, Case No.: CV-11-745374 (First chair, Jury Trial). I represented an automobile accident victim and successfully obtained a jury verdict in his favor.

Gary McKinnond, et al, v. Lesco Products, Inc., et al, Southern District of Florida, Case No.: 09-14276 (Second chair, Jury Trial). I defended Lesco Products, Inc. and Commercial Turf Products in product liability claim concerning a commercial walk-behind mower and successfully obtained a jury verdict in favor of the defendants.

Royal International, LLC v. United India Insurance Company Limited, c/o Trans Atlantic Marine Claims Agency., Stark County Court of Common Pleas, 2007 CV 03783. (First chair, Bench Trial). I prosecuted a breach of contract arising out of policy of marine insurance and successfully obtained a verdict in favor of Royal International $73,500.00 plus interest.

William Catlett v. Central Allied Enterprises, Inc., Columbiana County Court of Common Pleas, CV 06 CV 00667. (First chair, Bench Trial). I represented Central Allied Enterprises, Inc. in a dispute over alleged breach of contract during a public works project and successfully obtained a verdict in favor of Central Allied Enterprises.

Firestone Health Care. v. Ann Marie Bonetti D.O., et. al., Columbiana County Court of Common Pleas, 06 CV 936. (First chair, Injunction proceeding). I represented Firestone Health Care, a Family Practice, and successfully obtained injunctive relief against a former employee, a physician, who violated a covenant not to compete.

Roland Industries v. Murphy & Durieu, et. al., Holmes County Court of Common Pleas, Case No: 03 CV 057 (First chair, Jury Trial). I represented Murphy & Durieu, a New York Brokerage Firm, and successfully obtained a jury verdict enforcing an arbitration clause against a former customer.

Steel Products Corp. of Akron, Inc. v. Dale Rininger, et. al., Summit County Court of Common Pleas, CV-2005-07-3897. (First chair, Injunctive proceeding and Jury Trial). I represented Steel Products, a Cuyahoga Falls Machine Plant, and successfully obtained injunctive relief against a former employee who violated a covenant not to compete.

Udine Ellis, as Guardian of Lateasha Pendergrass v. Cleveland Municipal School District, US District Court, Northern District of Ohio, Case No. 1:03CV1284, (Second chair, Jury Trial). I represented CMSD and successfully defended a claim that a substitute teacher intentionally and/or negligently injured a student.

Fastcorp v. Centerior Service Company/FirstEnergy, Cuyahoga County Court of Common Pleas, Case No. 03-CV-509013 (First chair, Bench Trial). I successfully defended a breach of contract suit against Centerior/ FirstEnergy concerning marketing materials.

Vince Krofta v. Michael Stallard, et al., Berea Municipal Court, Case No. 02CVF00729 (First chair, Bench Trial). I successfully defended a claim that CEI’s employees committed negligence and an unlawful trespass on a utility customer’s property.

Ohio Bell v. The Cleveland Illuminating Company, Rocky River Municipal Court, Case No. 02 CVE 1696, (First chair, Bench Trial). I successfully defended a claim that CEI negligently excavated an underground electric cable.

Leila Benton v. The Cleveland Illuminating Company, Cuyahoga County Court of Common Pleas, Case No. CV-02-484134, (First chair, Jury Trial). I successfully defended a claim that CEI negligently constructed and maintained its utility poles.

State Farm Mutual Automobile Insurance Company v. The Cleveland Illuminating Company (First chair, Bench Trial), Bedford Municipal Court, Case No. 03CVE00079. I successfully defended a claim that CEI negligently constructed and maintained utility poles.

John Terchek v. FirstEnergy Corp., Willoughby Municipal Court, Case No. 02CVE00296 (First chair, Bench Trial). I successfully defended a claim that FirstEnergy’s Eastlake plant negligently emitted particulates causing health concerns and property damage.

Charles Tomei v. Mayfield City Schools, et. al., Cuyahoga County Court of Common Pleas, Case No. CV-99-381868 (Second chair, Jury Trial). I successfully defended a claim that a Cleveland Clinic employee committed negligence during the care of a student athlete.

Donald Malen and Sharon Malen v. MTD Products, Inc., et al., (US Court of Appeals for the Seventh Circuit., November, 2009), Appellate Case No. 08- 3855; briefed, argued and successfully defended MTD’s motion for summary judgment on Appeal.

Milling Away, LLC v. Infinity Retail Environments, Inc., (9th Dist. Ct. App., June, 2008), Case No. CA 24168; briefed, argued and successfully defended motion to stay and compel arbitration in favor of Infinity Retail Environments, Inc. arising out of a commercial dispute.

Hastings Mutual Insurance v. Tracy Halatek, et al., (7th Dist. Ct. App., November, 2007), Case No. 06 MA 102; briefed, argued and successfully defended summary judgment in favor of Erie Insurance as to a declaratory judgment concerning priority as to a commercial insurance policy concerning personal injury victim.

Erie Insurance v. The Estate of John Meier, et al., (9th Dist. Ct. App., September 2007), Case No. 07 CA 0012, upheld trial court decision; briefed, argued and appealed summary judgment as to Erie’s subrogation of property damage claim against deceased tortfeasor.

Guth v. Allied Home Mortgage, et al., (12th Dist. Ct. App., September, 2007), Case No. 2007-CA-02-029, decision pending; briefed, argued and defended bench trial verdict dismissing claims of fraud, OMBA violations, CSPA violations, negligence, breach of contract and breach of confidentiality.

Bhole Inc. vs. Standard Roofing (5th Dist Ct. App., June, 2007), 2006 CA 00285, argued and briefed declaration action involving waiver of arbitration clause.

FirstEnergy v. Moore (8th Dist. Ct. App., August, 2003), Case No. 82074, upheld trial court decision; briefed, argued and appealed RC 2323.51 issue as to summary judgment on premise liability issue.

Pacific Indemnity Insurance vs. Cleveland Electric Illuminating Company (8th Dist. Ct. App., January, 2003), Case No. No. 82074, briefed, argued and defended jurisdiction issue involving civil courts over P.U.C.O. matter.

State Farm Insurance vs. FirstEnergy (11th Dist. Ct. App., May, 2003), Case No. 2003-L-032CA, briefed, argued and successfully defended jurisdiction issue involving civil courts over P.U.C.O. matter.
